By accessing or using ProductVisuals's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

ProductVisuals provides an AI-powered product image generation platform for e-commerce sellers. Our service includes:

• Image-to-image transformation using AI (upload a product photo, receive a professional visual)
• Multiple visual style presets optimized for marketplaces and ads
• Credit-based usage tracking and management
• Image generation is powered by third-party AI infrastructure (Evolink API)

Credits are purchased as one-time packs. There is no subscription. 1 credit = 1 image generation. Credits never expire.

3. User Accounts

To use our services, you must create an account by providing accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

• You must be at least 18 years old to create an account
• You must provide accurate, current, and complete information
• You must keep your login credentials secure and confidential
• You are responsible for all activities under your account

4. API Usage and Limitations

Your use of ProductVisuals's API services is subject to the following terms:

• API keys are for your exclusive use and must not be shared
• Usage is subject to rate limits and quotas as specified in your plan
• You must not use the service for illegal or harmful purposes
• You must not attempt to reverse engineer or circumvent our systems
• Excessive use may result in temporary or permanent suspension

5. Payment and Billing

ProductVisuals operates on a one-time credit pack model:

• Credits are consumed at a rate of 1 credit per image generation
• Credit packs are purchased as one-time payments — no subscription
• Credits never expire once purchased
• Refunds are available for unused credits within 30 days — see our Refund Policy
• Prices may be updated with 30 days advance notice

6. Data and Privacy

We respect your privacy and handle your data in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

7. Intellectual Property

ProductVisuals and its services are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our services without our express written permission.

• The AI prompt generation technology and models remain our proprietary property
• You retain ownership of your input images, text, and generated prompts for legitimate use
• You grant us a license to process your content for service provision

8. Prohibited Uses

You agree not to use ProductVisuals's services for:

• Illegal activities or violation of any laws
• Creating misleading or deceptive content without proper disclosure
• Harassment, abuse, or harm to others
• Spam, phishing, or fraudulent activities
• Generating harmful, offensive, or inappropriate prompts
• Attempting to gain unauthorized access to our systems
• Interfering with or disrupting our services
• Violating intellectual property rights of others

9. Prohibited Content and Uses

ProductVisuals is an e-commerce product photography tool. The following content and uses are strictly prohibited on our platform:

Sexual and Exploitative Content

• Pornography or sexually explicit content of any kind
• NSFW (Not Safe For Work) imagery, nudity, or sexually suggestive content
• Sexual content involving minors (CSAM) — zero tolerance; violations will be reported to the relevant authorities
• Non-consensual intimate imagery (NCII), also known as "revenge porn"
• Any content that sexually exploits or degrades individuals

Harmful, Unlawful, and Abusive Content

• Content that is hateful, discriminatory, or harasses individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Content that promotes, glorifies, or facilitates violence, self-harm, or terrorism
• Content that is unlawful under applicable law, including content that infringes third-party intellectual property rights, defames individuals, or violates privacy
• Disinformation, deepfakes, or synthetic media intended to deceive

Enforcement

ProductVisuals reserves the right, at its sole discretion, to:

• Reject or block any image generation request that violates these prohibitions
• Remove or disable access to content that violates these Terms
• Suspend or permanently terminate accounts responsible for violations
• Report illegal content to law enforcement or relevant regulatory authorities

Violations of this section may result in immediate account suspension without refund.

10. Service Availability

While we strive to provide reliable service, we do not guarantee 100% uptime. We may perform maintenance, updates, or experience outages that temporarily affect service availability. We will provide reasonable notice for planned maintenance when possible.

11. Disclaimer of Warranties

ProductVisuals's services are provided "AS IS" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, ProductVisuals shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

13. Termination

Either party may terminate this agreement at any time. Upon termination, your access to ProductVisuals's services will cease, and any remaining credits may be forfeited. We may terminate or suspend your account for violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ProductVisuals operates, without regard to conflict of law principles.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through our service. Continued use of our services after changes constitutes acceptance of the new Terms.
